General terms and conditions

These General Terms and Conditions (hereinafter: GTC ) stipulate the rights and obligations of the Service Provider and the Customer in connection with browsing and shopping in the web store available on the website www.dollcini.hu (hereinafter: Website ). The customer can find all information about the Service Provider in the "Contact" section (section 11) and section 1. These General Terms and Conditions regulate the terms and conditions of the use of the Website by the purchaser in the online store available on the Website, as well as the user entering the Website (hereinafter: Customer ), the rights and obligations of the Customer and the Service Provider related to the use of the Website.


This contract will not be filed, it will only be concluded in electronic form, it is not considered a written contract, so it cannot be accessed or viewed afterwards.


In the event of questions regarding the operation of the Website, the order and delivery process, the Service Provider is available to Customers at the contact details provided in these Terms and Conditions (Contact point).


The service provider is not subject to the provisions of the code of conduct. Language of the contract: Hungarian.


The customer may not distribute the ordered products further without the consent of the Service Provider.


By using the Website, the Customer accepts the provisions of these General Terms and Conditions. The scope of these GTC covers legal relationships on the Service Provider's website ( http://www.dollcini.hu/) and its subdomains. This contract is concluded for an indefinite period.

  1. Basic provisions:

2.1. Questions not regulated in these Terms and Conditions, as well as the interpretation of these Terms and Conditions, are governed by Hungarian law, especially the 2013 Civil Code. to the relevant provisions of Act V of The mandatory provisions of the relevant legislation apply to the parties without special stipulations.


  1. The Service Provider is entitled to unilaterally amend the General Terms and Conditions. The modified GTC shall be applied to orders placed after its publication on the Website. By using the Website, customers accept that all regulations related to the use of the Website, available in these Terms and Conditions and elsewhere on the Website, automatically apply to them.
  2. If the Customer enters the Website operated by the Service Provider, or makes a purchase on the Website with or without prior registration, the Customer acknowledges that the provisions of the General Terms and Conditions are binding on him/her.

  1. The Service Provider reserves all rights regarding the Website, any part of it and the content appearing on it, as well as the distribution of the Website. Downloading, electronic storage, processing and sale of the contents appearing on the Website or any part of them is prohibited without the written consent of the Service Provider. However, Buyers are entitled to directly download, print, and save these Terms and Conditions, which is provided directly to Buyers based on these Terms and Conditions.

  1. Range of products available for purchase

3.1. All prices for products, including promotional prices, are valid until withdrawn or until stock is exhausted. If a Customer has already ordered the product, the price remains valid for that Customer. The displayed prices include the statutory VAT and other public charges, but do not include the home delivery fee. No separate packaging costs will be charged.


3.2. On the Website, the Service Provider displays the name and description of the product in detail, and displays photos of the products. The images displayed on the product data sheet may differ from reality, in some cases they are shown as illustrations.


3.3. If a promotional price is introduced, the Service Provider will fully inform Customers about the duration of the promotion.


3.4 The service provider only serves end users and does not engage in wholesale trade.


  1. The process of purchasing on the website

  1. Registration:

Browsing and shopping on the Website is possible after registration on the Website and without registration, prior registration is not required for browsing and shopping on the Website. The Customer also has the option to order the selected product at the Service Provider's customer service contact details set out in point 11 of these GTC, either by e-mail or by phone, regardless of whether the Customer is registered on the website.

  • Company name; company registration number, tax number (if relevant)

On the same registration form interface, the Customer also has the option to subscribe to the Provider's newsletter by ticking the box before the text "I would like to be notified about new products, promotions and gift coupons".


By clicking on the button labeled "Register" at the bottom of the registration form, you can record the registration on the Website with the data provided on the registration form. After clicking on the "Register" button, the Service Provider immediately sends a confirmation e-mail about the data entered during registration, thereby providing the opportunity to check them.


After registration, the "Personal data" page will automatically appear, on which the Buyer has the opportunity to change the data entered during registration and to enter a delivery address by ticking the box before the text "I would like the package to another address" if the goods are not requested for the address specified during registration delivery. You can save the changes by clicking the "Save changes" button at the bottom of the page.


On the page that appears after registration, the Buyer can not only manage (change) his data and the delivery address, but also view his previous orders by clicking on the "My Orders" button, and by clicking on the "Logout" button, and then log out of the Website after confirming the logout.


After registration, the Buyer is automatically logged in to the Website and can start shopping.


  1. Login:

If the Customer has previously registered on the Website, in the upper right corner of the Website

You can log in to the Website by clicking on the text "Sign in" and then by clicking on the "Login" button, entering the e-mail address and password you provided during registration. If the Customer wishes to log out of the Website, he can do so by clicking on the text "My Customer Account" in the upper right corner of the page and "Logout" within it.


The customer can cancel his registration by sending an electronic message to the e-mail address info@dollcini.hu . After receiving the message, the Service Provider will delete the registration. By canceling the registration, the Customer's data will also be deleted from the system; however, the Service Provider retains the data and documents related to purchases prior to this.


  1. Order:

On the Website, in the upper horizontal menu bar, you can browse the products offered by the Service Provider for sale via the Website, grouped according to product categories (e.g. special offers, perfumes, Niche, face, body, make-up, etc.).


If the Customer places the mouse on a product category in the upper horizontal menu bar, he can click on the product categories in the horizontal menu bar. Then all the products available on the Website and belonging to the selected product category will appear on a new page.

If the products belonging to the given category do not fit on one page, it is possible to scroll by clicking on the arrows and page numbers at the top and bottom of the page, and by clicking on the button labeled "More 15" at the bottom of the page, scrolling down on the same page will display additional products.


If the Customer places the mouse on a product category in the upper horizontal menu bar, narrower subcategories within the given product categories will appear in the drop-down window. If the Customer clicks on a subcategory, the products offered for sale by the Service Provider within the given product category will appear on the Website. If the products belonging to the chosen subcategory do not fit on one page, it is possible to scroll by clicking on the arrows and page numbers at the top and bottom of the page, and by clicking on the button labeled "More 15" at the bottom of the page, scrolling down on the same page will display additional products.


On the same page, in the vertical menu bar on the left, you can narrow down the range of products you are looking for (e.g. by price, brand, etc.).


If the Customer moves the mouse over the given product, the product's data sheet will appear in a drop-down window. If the Customer clicks on the photo or name of the selected product, he can get additional information about the product (e.g. expected date of product receipt/delivery, more detailed description, customer evaluation, product size, possible versions, other related products, etc.), and can order the selected product .


The Customer can also browse the products by entering the name, brand, other characteristic of the desired product or the name of the specific product in the search field above the top horizontal menu bar on the Website. If the Service Provider offers a product for sale on the Website that corresponds to the information entered in the search field, the search results will display the products matching the search criteria in the same way as on the page that appears when clicking on the product categories and subcategories in the upper menu items. In this case, it is also possible to flip between the pages and view the product data as described above.


By clicking on the given product, the Customer can find out how many and which product versions the given product has (e.g. the same product is available in several packages) on the page that provides more detailed information about the given product. In addition to the individual product versions, the quantity to be ordered can be selected and by clicking on the button labeled "add to cart", the Customer can place the product of the given version and specified quantity in the virtual shopping cart. There are products on the Website of which only one version is available, in which case only this one product appears among the product versions. The quantity of such a product is selected and placed in the basket as described above.


The contents of the basket (the number of selected products and the gross amount of the order) are displayed in the upper right corner of the homepage, next to the "Shopping bag" icon. If the Customer moves the cursor to the "Shopping bag" icon, a photo of the ordered product/products and their brief description will appear in a drop-down window, and at the bottom of this is a button labeled "Jump to the basket", by clicking on which the Basket interface will appear. The Cart interface can also be accessed if the Customer clicks on the "Shopping Bag" icon in the upper right corner of the Website or on the text next to it (cart contents, then quantity and the gross price of the products in the cart).


On the basket interface, the Buyer can view and check the list of products placed in the basket, their gross price, the selected quantity, and the total gross amount of the consideration for the ordered goods at the bottom of the summary table.

On this interface, the Customer can also modify the contents of his basket: he has the option to delete a product from his basket by clicking on the "remove" text, and he also has the option to change the quantity of the given product to be ordered by clicking on the + and - buttons.


On the Cart interface, the Buyer also has the option, if he has a discount or gift coupon, to enter its code in the field marked for this and to use the discount by clicking on the text "OK".


By ticking the check box before the text "Ensure the shipment at a discount price" on the Cart interface, the Customer can ensure the delivery of the product in exchange for the consideration in the line corresponding to the check box. If the Buyer uses this option, the gross price appearing at the bottom of the product list includes this cost.


By clicking the Back to shopping button, the Buyer can continue browsing the products and expand and modify the contents of the Basket. In this case, the Website will direct the Customer back to the page visited immediately before entering the Basket interface.


By clicking the "Order" button on the Cart interface, the Customer can continue the order. The Website will then take you to a page where the Website offers the purchase of additional discounted products. On this page, you can return to the Cart interface by clicking the "Back to previous page" button. By clicking on the "Continue" button - if the Buyer purchases by logging in after prior registration - the Website navigates to the page for specifying the method of delivery and payment, where the Buyer must select the method of delivery and payment. After selecting the specific pick-up point, the Customer can find out about the exact location and opening hours of the pick-up point.


Budapest - Parcel pick-up delivery method can be selected in the drop-down window by ticking the circle before the text Budapest - Parcel pick-up.


The payment method can be specified in the column on the right. Payment on the Website can be made by cash on delivery, bank transfer and bank card. The payment method can be selected by ticking the circle in front of it.


By clicking on the "Back to previous page" button on this page, we return to the previous page offering discounted products. On the same page, by clicking on the "Continue" button, we can continue to enter the delivery address and the order

to the summary page. Above the "Continue" button, the gross price of the ordered products and the delivery fee according to the selected delivery method, as well as the total amount to be paid by the Buyer (gross consideration + delivery fee) will appear again.


On the page for specifying the delivery address, the Buyer's personal data must be entered in the left-hand column (for registered users, the data entered during registration will be displayed automatically after logging in). By ticking the box in front of the text "Request the package to another address", the Buyer has the option to enter another delivery address. If you want to request an invoice in the name of a company, you have the option to enter the billing company name, the company's headquarters and its tax number.


On the same page, more precise information can be added to the order for the website operator or the supplier. By ticking the text box in front of the text "I would like to receive notifications about new products, promotions and gift coupons", the Customer can subscribe to the Service Provider's newsletter. Before clicking the "Buy now" button, the Buyer must declare that he has read and accepts these General Terms and Conditions by checking the text box in front of the text "I have read and accept the General Terms and Conditions". By ticking the same text box, the Buyer also acknowledges that by pressing the "Buy now" button, his order will be sent to the Service Provider, it will be final, and the purchase will result in a payment obligation for him.


On this page, in the right-hand column, you can find the summary of the order, the total amount to be paid by the Customer (gross price of the product + shipping costs).


By clicking the "Buy now" button located at the bottom right of the page, the Buyer definitively sends his order to the Service Provider, which creates a payment obligation for the Buyer.


  1. Order confirmation

After sending the order, the Customer will receive a confirmation email with the details of the order. The confirmation e-mail is regarded as the Service Provider's declaration of acceptance, thereby creating a contract between the Service Provider and the Customer. If this confirmation is not received by the Buyer within the expected time frame, depending on the nature of the service, but no later than 48 hours after sending the Buyer's order, the Buyer will be released from the binding offer or contractual obligation. The order and its confirmation shall be deemed to have been received by the Service Provider or the Customer when it becomes available to him. The Service Provider excludes its liability resulting from the violation of the confirmation obligation, if the confirmation is not received on time because the Customer entered the wrong e-mail address during registration, cannot receive messages due to the storage space belonging to the account being full, internet, server, other technical in the event of an error or for any other reason that can be traced back to the Buyer's carelessness.


As an attachment to the confirmation e-mail, the Service Provider sends the Customer the order form associated with the order, which summarizes the order data: the order number and date, the name and contact information of the customer, the method of delivery and payment, as well as the name and quantity of the ordered product, gross consideration, costs and the total amount to be paid.


The Service Provider will notify the Customer by e-mail about the status and data of the order, so that they can track the order. The Customer can view his/her previous orders by clicking on "My Customer Account" in the upper right corner of the Website and clicking on the "My Orders" button.

  1. Correction of data entry errors:

At any stage of browsing and shopping on the Website, until the order is finally sent to the Service Provider, the Customer has the opportunity to correct data entry errors on the Website at any time, for example by clicking the "Personal data" button in the customer account and clicking the "Save Changes" button after making the changes, or also during the ordering process (e.g. changing the quantity of the product placed in the basket on the basket surface by clicking on the + and - signs or deleting the product from the basket by clicking on the "remove" inscription, and the Buyer clicking on the "Back to the previous page" button to complete the purchase during the process, you can return to an earlier step of the purchase and change the data there according to the previous ones).


  1. Processing orders and fulfilling the contract

The service provider processes orders received by 11:00 a.m. the same day, but no later than the next day.


On the data sheet of each product, the Service Provider indicates the expected delivery/delivery time of the given product, which is usually 2 working days. Although 100% of the products that can be ordered are in stock, it may happen that this time is exceeded by the Service Provider. In this case, the Service Provider will immediately contact the Customer and discuss further steps with him.


If the Service Provider does not fulfill its obligations in the General Terms and Conditions because the ordered product is not available, it is obliged to inform the Customer immediately, as well as refund the amount paid by the Customer immediately, but no later than within thirty days, or offer an exchange option or a discount. Fulfilling this obligation does not exempt the Service Provider from other consequences of breach of contract.


If the Service Provider performed with a substitute product, the costs incurred in connection with the return of the product due to the exercise of the right of withdrawal according to these GTC shall be borne by the Service Provider. In this case, the Buyer is obliged to return the product by courier or by post to the address of the Service Provider's customer service specified in point 11 of these GTC, in such a way that the cost of the courier and the post does not need to be paid in advance, but will be paid by the Service Provider upon receipt. In case of questions, the Service Provider is available to the Buyers at the customer service specified in point 11. The Service Provider is obliged to clearly and precisely inform the Customer about the bearing of the costs and the performance with a suitable substitute product.


As soon as the package has been delivered by the Service Provider, the Customer will be notified by e-mail, if the Customer wishes to know the package number, the Service Provider will also send it to him. Delivery will take place on the working day following this notification, so the Buyer will usually receive the ordered goods within 2 working days of the order.


  1. The price of the Products, terms of payment:

The purchase price of the products displayed on the Website is the gross price including VAT and other public charges.


The gross purchase price indicated next to the products does not include the cost of delivery, but packaging costs are not charged.


The price of the products is determined in Hungarian forints (HUF).

The total amount to be paid by the Buyer includes all costs based on the summary of the order (step 4 in the purchase process) and the order form sent as an attachment to the confirmation e-mail, including the delivery fee and the amount of any insurance. If the Customer used a discount during the purchase process, the order form attached to the confirmation message also contains the amount of the discount.


The Buyer can choose between the following payment methods:


  • Payment by cash on delivery - When the courier receives the package, you must pay the total amount of the order after the ordered products in cash or by bank card.
  • Bank transfer - if the Customer has chosen the bank transfer payment method during the purchase process, the Service Provider will send the Customer's bank account number and identifier after receiving the Customer's order. As soon as the payment for the order is credited to the Service Provider's bank account, the Service Provider sends the ordered product to the Customer and informs him of the delivery date.
  • Payment by bank card: The consideration for the order can be paid immediately during the purchase process by bank card with VISA, VISA Electron, Master Card and Maestro cards. If you choose to pay by bank card, you can enter your bank card details by clicking on the "Pay by credit card" button on the "Order summary" page that appears after the order has been sent. On the same page, which is used to enter the bank card data, in the vertical column on the left, the Buyer can also choose the Masterpass and Master Card mobile payment methods.


Use of discounts and coupons :


The Service Provider provides different discounts for the Buyers. There are different conditions for using each discount.


The description of the conditions of use can be found directly in the information section of the discount coupon, or on the website under the "Specials" menu item. If the interpretation of the terms of use causes difficulties, the Service Provider provides assistance in their interpretation at the contact details set out in these General Terms and Conditions.

Use of discounts and coupons: Each discount or coupon can only be used once, unless the text on the coupon specifically states otherwise. In the event that the Customer wishes to use the same coupon more than once, despite the fact that the coupon only entitles it to one-time use, the Service Provider has the right to refuse to apply the discount. If the value of the gift coupon is greater than that of the order, the difference cannot be transferred to the next order and its refund cannot be demanded. In the event that the use of the coupon conflicts with the Service Provider's business conditions, the Service Provider has the right to refuse the use of the coupon. In this case, the Service Provider informs the Customer and provides the opportunity to purchase without using the discount or promotion.


  1. Conditions of Carriage:

Buyers can choose delivery methods:


Ø Budapest- Package pick-up – No shipping costs


The shipping cost is HUF 0.00 if you choose the Budapest-Parcel pick-up delivery method. If this delivery method is chosen, the Buyer can personally collect the ordered product without paying any shipping or other delivery costs on the following

The Customer can pick up his package at the collection point from Monday to Friday from 9:00 a.m. to 4:00 p.m. The Service Provider notifies the Customer by SMS and e-mail about when he can receive the ordered product. Only cash payment is possible at the pick-up point!


Ø Sameday Delivery with courier service


The shipping cost for sameday delivery is HUF 1,500. In case of delivery with the Sameday Delivery courier service, the ordered product is delivered by the Sameday Delivery courier service. The service provider will deliver the product within one working day from the time it is prepared for dispatch. After preparing to send the product, the Service Provider informs the Customer by e-mail about the information related to the delivery, including the package number. In the Sameday Delivery online system, the Buyer can check where his package is at the given moment.


If the courier does not reach the Customer at the specified delivery address, the package will be sent to the Sameday Delivery depot, and the Customer will receive a notification in his mailbox about the delivery attempt, which also contains a telephone number through which he can coordinate the delivery date with the Service Provider. The price of the order delivered by the Sameday Delivery courier service must be paid by the courier if you chose the cash on delivery payment method. The courier can pay in cash or by credit card.


The Buyer is obliged to thoroughly check the package delivered by the courier. If you notice any mechanical damage, do not accept the package! If possible, open the package in front of the courier. If it is damaged, report it immediately. If you only notice the damage later, Sameday Delivery will no longer accept the claim. The Service Provider is not responsible for damage caused during transport.


Ø Parcel sender - receiving location


The shipping cost for delivery through a parcel delivery point is HUF 700. The Service Provider delivers the ordered package within the courier's network to the delivery location selected by the Customer during the ordering process. The package will be delivered to the selected pick-up location within two working days at the latest. The Service Provider notifies the Customer by e-mail about the start of the delivery, and sends him the package number. You can check the status of your package online here. If the package arrives at the pick-up point, the Service Provider notifies the Customer by e-mail and SMS when the pick-up is possible, and also sends the password required for pick-up. The package will be at the receiving location for 7 days. Only cash payments are possible at the mail order pick-up points!


  1. Right of withdrawal and termination

The provisions of this section apply exclusively to natural persons acting outside the scope of their profession, independent occupation or business activity, who buy, order, receive, use, use goods, as well as the recipient of commercial communications and offers related to the goods (hereinafter "Consumer").

  1. The Buyer is entitled to withdraw from this contract without giving reasons within 14 days. Similarly, if in the case of a contract for the provision of services, the performance of the contract has begun, the Customer has the right to terminate the contract within 14 days without giving reasons.

In the case of a contract for the sale of products, the cancellation period expires 14 days after the day on which the Customer or a third party indicated by the Customer, other than the carrier, receives the product, in the case of multiple products, it expires after 14 days after the day on which the Customer or a third party other than the carrier designated by the Buyer takes over the last product, in the case of a product consisting of several lots or pieces, in which the Buyer or a third party other than the carrier designated by the Buyer takes over the last lot or piece. In the case of a contract for the provision of services, the notice period expires 14 days after the date of conclusion of the contract.


  1. If the Buyer wishes to exercise his right of withdrawal or termination, he must send a clear statement containing his intention to withdraw/terminate (e.g. by mail or electronically) to the following address:

For your convenience and to ensure the safe delivery of the returned product, we recommend using GLS or Sameday Delivery. Please note that Magyar Posta Zrt. has lost packages in some cases, and we would like to avoid further complications.

The buyer can also exercise his right of withdrawal/termination by telephone at the following telephone number:

  1. The buyer exercises his withdrawal/termination statement within the deadline if he sends his withdrawal/termination statement before the expiration of the above-mentioned deadline. In both cases, the Service Provider will immediately confirm by e-mail the receipt of the Customer's withdrawal/termination statement. In the event of notification by post, the Service Provider takes into account the date of mailing, and in the case of notification via e-mail, the time of sending the e-mail for the purpose of calculating the deadline. The Buyer sends the letter as registered mail so that the date of posting can be reliably proven.

  1. The above does not affect the Buyer's right to exercise the right of withdrawal specified in this clause during the period between the date of conclusion of the contract and the date of receipt of the product.

  1. Legal effects of withdrawal/termination

  1. If the Customer withdraws from this contract, immediately, but no later than within 14 days from the date of receipt of the withdrawal statement, the Service Provider will refund all the compensation provided by the Customer, including the cost of transportation (except for the additional costs incurred due to the Customer using the services offered by the Service Provider , chose a mode of transport other than the cheapest usual mode of transport.) During the refund, the Service Provider uses a payment method identical to the payment method used during the original transaction, unless the Buyer expressly consents to the use of another payment method; due to the application of this refund method, the Buyer will not be charged any additional costs. The Service Provider may withhold the refund until the product has been returned or the Customer has not confirmed that it has been returned: the earlier of the two dates shall be taken into account.

  1. The Customer is obliged to return the product to the Service Provider without undue delay, but no later than within 14 days from the date of communication of the withdrawal statement. The deadline is considered met if you send the product before the 14-day deadline. You can return the ordered product to the Service Provider by post or using a courier service.

the cost of returning the product shall be borne by the Customer, except in the case where the Service Provider provided a replacement product. (In the latter case, the costs incurred in connection with the return of the product due to the exercise of the right of withdrawal will be borne by the Service Provider (see clause 4.5 of these GTC)). It is not possible for the service provider to accept the package returned by cash on delivery. Apart from the cost of returning the product, the Customer will not be charged any other costs in connection with the cancellation. The buyer can only be held responsible for the decrease in value of the product if it occurred due to use exceeding the use necessary to determine the nature, properties and operation of the product.


The Service Provider may therefore demand compensation for depreciation and reasonable costs resulting from use exceeding the use necessary to determine the nature, properties and operation of the product. The service provider may demand compensation for material damage resulting from improper use.


If the Customer requested that the performance of the service begin within the notice period, in the event of termination, the Customer is obliged to reimburse the Service Provider the amount due for the service performed proportionally until the date of termination of the contract. Similarly, the Service Provider will refund the part of the consideration provided by the Customer that exceeds the consideration for the service provided by the Service Provider.


If, in the case of a contract for the provision of a Service, the Customer exercises the right of termination after the commencement of performance, he shall reimburse the Company's reasonable costs during settlement.

In the event that the product is returned incomplete, damaged or visibly used, the Service Provider may request compensation for the damage.


  1. The Buyer must pay particular attention to the intended use of the product, as the Buyer is responsible for compensation for damages resulting from improper use.

    1. Accessories warranty

In what cases can the Customer exercise his accessory warranty right?

In the event of defective performance by the Service Provider, the Customer may assert a warranty claim against the Service Provider in accordance with the rules of the Civil Code.


What rights does the Customer have based on his claim for warranty?


The customer - at his choice - can make use of the following accessory warranty claims:


You can request a repair or replacement, unless the fulfillment of the request chosen by the Customer is impossible or the Service Provider would incur disproportionate additional costs compared to the fulfillment of other requests. If he did not or could not ask for the repair or replacement, he can request a proportional delivery of the compensation or the Customer can repair the defect at the Service Provider's expense, or have it repaired by someone else or - in the last case - withdraw from the contract.


You can switch from your chosen accessory warranty right to another, but the cost of the switch is borne by the Customer, unless it was justified or the Service Provider gave a reason for it.


What is the time limit for the Customer to assert his accessory warranty claim?


The buyer is obliged to report the defect immediately after its discovery, but no later than within two months from the discovery of the defect. At the same time, you may no longer assert your accessory warranty rights beyond the two-year statute of limitations from the date of execution of the contract.


Who can you enforce your accessory warranty claim against?


The customer can enforce his accessory warranty claim against the Service Provider.


What other conditions are there for asserting your accessory warranty rights?


Within six months from the date of delivery, there is no other condition for asserting the Customer's warranty claim for accessories other than the notification of the defect, if the Customer proves that the product or service was provided by the Service Provider. However, after six months from the date of performance, the Customer is obliged to prove that the defect recognized by the Customer was already present at the time of performance.

In what cases can the Customer exercise his product warranty right?


In the event of a movable thing (product) defect, the Buyer - at his option - in accordance with 6.1. you can enforce your right or product warranty claim specified in point.


What rights does the Buyer have based on his product warranty claim?


As a product warranty claim, the Buyer may only request the repair or replacement of the defective product pursuant to Art. 6:168. Based on paragraph (1) of §


In which case is the product considered defective?

The product is defective if it does not meet the quality requirements in force at the time it was placed on the market or if it does not have the properties described by the manufacturer.


In what time frame can the Customer assert his product warranty claim?


The Buyer may assert a product warranty claim within two years of the product being placed on the market by the manufacturer. After this deadline, you will lose this right.


Against whom and under what other conditions can you enforce your product warranty claim?


You may only exercise your product warranty claim against the manufacturer or distributor of the movable item. In the event of a product warranty claim, the Buyer must prove the defect of the product.


In what cases is the manufacturer (distributor) exempt from product warranty obligations?


The manufacturer (distributor) is only released from its product warranty obligation if it can prove that:


  • the product was not manufactured or marketed as part of its business activities, or

  • the defect was not detectable according to the state of science and technology at the time of placing it on the market or

  • the defect of the product results from the application of legislation or mandatory official regulations. It is sufficient for the manufacturer (distributor) to prove one reason for the exemption.

Due to the same fault, an accessory warranty claim and a product warranty claim cannot be asserted at the same time, in parallel with each other. However, in case of successful enforcement of the Buyer's product warranty claim, he may assert his accessory warranty claim for the replaced product or repaired part against the manufacturer.

The Buyer can assert his claim for accessories and product warranty by e-mail or letter to the customer service contacts indicated in the "Contact" section (section 11 of these General Terms and Conditions) of the Service Provider.   1. Warranty

The service provider does not sell products that are subject to a mandatory warranty.


  1. Miscellaneous Provisions

    1. If any part of these Terms and Conditions becomes invalid, void or unenforceable, the validity, effectiveness and enforceability of the remaining parts will not be affected.

  1. If the Service Provider does not exercise its right under the General Terms and Conditions, the failure to exercise the right cannot be considered a waiver of the given right. A waiver of any right is only valid if expressly stated in writing. The fact that the Service Provider does not strictly adhere to an essential condition or stipulation of the General Terms and Conditions on one occasion does not mean that it waives its obligation to adhere strictly to the given condition or stipulation in the future.

  1. Complaint handling procedure

  1. The aim of the Website is to fulfill all orders in good quality, with the complete satisfaction of the Customer. If the Customer still has any complaint regarding the contract or its performance, the complaint can be made in accordance with the present General Terms and Conditions "11. You can also communicate via e-mail, verbally by phone or by post at the contact details specified in the "Contact" section.

  1. The service provider examines the verbal complaint immediately and remedies it as necessary. If the Customer does not agree with the handling of the complaint or the immediate investigation of the complaint is not possible, the Service Provider shall immediately record the complaint and its position in relation to it, and in the case of a verbal complaint made in person, hand over a copy of it to the Customer on the spot, by telephone or other means in the case of a verbal complaint communicated using an electronic communication service, it will be sent to the Customer at the latest at the same time as the substantive answer, or if all this is not possible, then it will proceed according to the rules for written complaints detailed below.

  1. The Service Provider is obliged to respond in writing to the written complaint within 30 days of its receipt and take measures to communicate it. The Service Provider shall justify its position rejecting the complaint. The Service Provider shall keep the record of the complaint and a copy of the response for 5 years, and shall present it to the inspection authorities upon their request.

  1. Other Remedies

If the consumer legal dispute between the Service Provider and the Customer is not settled through negotiation, the following legal enforcement options are available to the Customer (consumer):


  1. the consumer is entitled to initiate the procedure of the Conciliation Board competent according to his place of residence, place of stay or the seat of the Service Provider:

This can be downloaded at any time from the e-mail in which the Customer is informed that the package has been handed over to the courier service.
